anybody able to help with this legal question

hey guys, i'm needing some help on this legal ?, here in Rhode Island. how does one remove a boyfriend from a rental domicile. my daughter's boy friend refuses to leave her apartment, even tho he isn't on the lease. she begs him to go, and he says he will when and if he feels like it. so they sit in silence, until they've both drink enough alcohol, and then they start to fight. the local police told me that after 2 weeks, there is a real dilemma getting someone out. anyone got any suggestions? i'm afraid someone will get hurt...juliek

Juliek, here's my thought: She could tell the landlord to ban him off the property. Then if he is dumb enough to return, he will go to jail for trespassing. or she could file a vpo if possible. 

If she doesnt want him to get in any legal trouble, her best bet is to get another man to come over to run him off, but that could get ugly.

hi juliek. i'm feeling for you on this one hon. i would have to agree with pat07 and bring this issue to the landlords plate to digest.

the boyfriend is not on the lease. therefore, perhaps she has broken the lease agreement by having boyfriend there without approval? i would go the manager or leasing agent of the property and have them serve him an eviction notice.  regarding the comment from the feds that it would be difficult to get the boyfriend to leave after a few weeks....i'm not sure what law that would be - - it is too short of a term for him to claim "squatters rights."

also, if boyfriend is not on any type of documentation at the rental office as even a sub-letter, he is not protected. change the locks, place his things outside in a box and eight-six is .....arse.

yeah, the cops suggested having the landlord issue a restraining order, but she shouldn't have let the guy move in, in the 1st place. he just is determined to stay and push buttons. my daughter has already been in trouble because of this idiot, (and her temper). i know he owes court fines, so i'm hoping there is a bench warrant issued for him. that way the cops can just come and arrest him. he's a true blue crack head, and spends every cent he can get his hands on.ugghh!!! i need an answer...juliek

Well, back when I was married, my ex and I were the supers of a 15 unit apartment building here in NJ.  We had a similar situation, the guy in the apartment above us let his girlfriend move in, she wasn't on the lease, and....she went psycho.  He tried to get rid of her, but she just wouldn't leave.  In his case, he was able to obtain a restraining order against her, and that was enough to keep her out.  Of course, the cops had been called because of their fighting more times than I could count by then, but once he got the restraining order, we never saw her again.

thanks for all the help you guys...really, i mean it. i submitted my dilemma to the website that gave me and hopefully they'll know just what i can do, altho i'd be a fool to believe that. i do know that she can't remove his belongings. it's illegal here. and as far as going to the landlord...he's pretty tired of them...there always late and just 3 weeks ago they had to come up with $3000 or they were getting tossed...real nice tenants, huh? you might wonder why i'm even involved...we are in the other half of the duplex, and any time the police come, my daughter hollers for me. she's a drinker and can really get the drama dancing...oooh,i dunno, this is a very depressing subject so close to Christmas. anyway, thanks again, and Merry Christmas should i not talk to you guys before then...juliek
